Lanetur S.A and Executive Branch at loggerheads over hotel licence

The Executive Branch states that Lanetur S.A has not met the tender specifications dating back to 2005

The Executive Branch of Uruguay has retracted a 2005 judgement which authorised Lanetur S.A. to build a five star hotel featuring a casino off the coast of Rocha, as the government aims to push for a new tender.

Lanetur S.A has already appealed this decision with the hope to restart activities and to initiate a ‘millionaire trial’ if the decision is not overturned.

The company feels that the reason for their licence being revoked is due to their past history as it is not the first time were the Executive Branch has removed their licence. Therefore, Lanetur S.A feel that there is a direct link between the decision and their past licence cancellations.

Uruguayan President Luis Lacalle Pou signed a resolution to revoke Lanetur’s license and stated that, once the Tourism state entity of the Rocha government gives the go-ahead, they will continue the planned project of a luxury casino hotel.

According to official governmental document, signed by president Lacalle Pou Luis, established that:

By virtue of the long time elapsed and the numerous requests made by the Administration as it arises from the file, Lanetur S.A. has not established compliance with the minimum requirements for the conclusion of the concession contract set out in the Executive Branch Resolution dated 5 September 2005 and in the Fold of Bases and Special Conditions of the Public Tender.

Additionally, the Chair of the Executive Branch stated that Lanetur S.A. has not complied with requirements outlined in the Tender Specifications and Bases after over 15 years since it was awarded its licence.

Therefore, they feel that Lanetur S.A has not performed at the required level that the contract stipulates.

Due to these reasons, the Government considered revoking ‘the Executive Branch Resolution of 5 September 2005 authorised the direct contracting of Lanetur S.A. for the construction, concession and operation of a 5-star hotel with a casino on the coast of the Rocha department’.
