Online gambling regulations published in Peru

On October 13, 2023, the Peruvian government published regulations for the implementation and regulation of online gambling.

Supreme Decree?No 005-2023-is a document which regulates the enabling law, Law No. 31557, establishing regulations for remote gaming and sports betting.?

Law No. 31557 was previously amended?by Law No. 31806 to establish a licensing regime for online gambling. When the Bill was signed last year, it had allowed the Peruvian government to introduce a 12% tax on net income and it had been estimated that it would generate an annual collection of about $40m for the State, allowing it, in the words of the then Peruvian President Pedro Castillo, “to have more resources to meet its economic and social obligations”.

The Supreme Decree establishes a regulatory framework that allows MINCETUR, the Ministry of Foreign Trade and Tourism, the authority to license and regulate online gaming and sports betting.

The regulations give MINCETUR the authority to register, amongst others, technological platforms and their partners, online gaming programmes, live casino games, sports betting terminals and related service providers. The regulations also address advertising restrictions and responsible gaming terms.

 Among others, the regulations address technological standards, advertising restrictions, and responsible gambling provisions. 

The Supreme Decree also allows unregulated operators 30 days from the effective date of the regulations, specifically March 9  to apply for a license and become a legal operator in Peru. 

The regulations become effective 120 days from publication, with some sections of the regulations outlining specific compliance timelines for operators and licensees.
